Question Details:

I recently received a DUI but have not gone to court yet. This is my first (and hopefully last) offense. I'm just wondering what I should expect for probation — is probation always the same, regardless of how many offenses you have?

Criminal Defense Attorney Response:

Unfortunately, there isn't a clear-cut answer to your question. The decision is highly circumstantial and without knowing all of the details, it is hard to say. This being your first offense, however, should help you out to some extent.

The most important thing you can do is hire an aggressive DUI attorney who is familiar with the local court system. It's possible that with the right lawyer you won't even be convicted, in which case probation wouldn't be a concern.

In summary, hire a knowledgeable attorney. A DUI on your record can lead to long-term consequences such as increased insurance premiums or loss of your driver's license, job prospects and custody disputes. “
