Does 50/50 Custody Pay Child Support?
Does 50/50 Custody Pay Child Support?
In Wisconsin, child support is calculated from the amount of overnights a parent has with their children. In this video, Attorney Austin Miller of Sterling Law Offices explains how people often confuse custody and placement and why the better place to start when calculating child support is to first determine placement.
In Wisconsin, child support is determined by placement or the number of overnights a parent has with their children. The mistake that is often made is confusing child support and placement. Custody is decision making. So, in Wisconsin it is important to first understand the difference between child custody and placement before one starts to calculate the amount of child support that will be owed.
One parent will always have to pay child support unless both parents get the children the exact amount of time, or overnights, and make the exact same amount of income. Additionally, unless both parents have more than 92 overnights a year the amount of child support owed will be a fixed percentage of income for each child in the family.
Child support is calculated from all income earned. This includes, but is not limited to, wages and salary, overtime, commissions, tips, bonuses, rental income, and investment income. In Wisconsin, child support will be calculated from estimated gross income.
