Question Details:

I accidentally missed my deadline to extend my maintenance. I still would like to file the motion, as I do need an extension. Will the court forgive my mistake and allow the motion to be filed?

Thank you for your question. Unfortunately the court is not very forgiving in regards to missing deadlines.

It was discussed in Lippstreu v. Lippstreu 125 Wis.2d 415, 373 N.W.2d 53 (Ct. App. 1985) that revision of maintenance can occur as long as the petition for revision is filed before the termination date of the limited maintenance payment set forth in the judgment, if the deadline is missed it cannot be filed.
